DPR Finalizes New Statewide Regulation on Use of Pesticides Near Schools and Daycare Centers

•    Requires annual notification on pesticides expected to be used
•    Effective on January 1, 2018 (start of restricted applications within ¼ mile buffer zones)
•    First annual notification due no later than April 30, 2018.

Under the proposal, new restrictions would be placed on pesticide applications made within ¼ mile 
of schools and daycare facilities. Key elements of the proposal include:

•    ¼-Mile Buffer Zone: Prohibits certain pesticide applications (see next bullet) within a 
quarter mile of public K-12 schools and licensed child day-care facilities during school hours, 
Monday through Friday between 6 a.m. and 6 p.m.

•    Restricted Applications: All applications by aircraft, sprinklers, air-blast sprayers, and all 
fumigant applications. In addition, most dust and powder pesticide applications, such as sulfur, 
will also be prohibited during this time.

•    Annual Notification: Requires California growers, by no latter than April 30 of each year, to
provide annual notification to public K-12 schools and licensed day-care facilities, as well ascounty agricultural 
commissioners, of the pesticides expected to be used within a quarter mile of 
these schools and facilities in the upcoming school year (Covering July 1 of current year through 
June 30 of the following year). Note when a grower takes control of new land, they will have 
30-days to comply with the annual notification.

•    48-hour Notification: If a pesticide needs to be used and it was not included in the annual 
notification, then the operator of the property will need to provide information on the pesticide 
to the schoolsite and commissioner at least 48 hours prior to the application.
